1. The purpose of these General Conditions of Sale is to regulate the relationship between CAFÉ RICO S.L.U. (hereinafter CAFÉ RICO), a commercial entity of Spanish nationality, with address at Ctra. Vieja de Bunyola, 29, postal code 07009 of Palma, Balearic Islands (Spain), with CIF B07007305, and The Client, regarding all the transactions made through the website www.caferico.net.

2. Each order placed with CAFÉ RICO through the Internet will be governed by these General Conditions of Sale. By placing an order, the Customer acknowledges that he has read, understood and accepted, without reservation, these General Conditions of Sale, so we remind him of the convenience of reading them carefully.
2.1 CAFÉ RICO reserves the right to modify these General Conditions of Sale, through the publication on this same page of an updated version of the same, which will be applicable to all those orders that are made after the moment in which CAFÉ RICO publishes the new version of its General Conditions of Sale on the website.
3. Orders
3.1 By placing an order through this website, the Customer makes a request to buy the products they have selected under these General Conditions of Sale.
3.2 Orders placed by the Customer through this website are subject to minimum quantity limits. The minimum order will be 5€.
3.3 The products are offered on this website within the limits of the quantities available. Should your order exceed stock, you will be notified immediately.
4. Order Confirmations
4.1 With the acceptance of these General Conditions of Sale, the orders made through the Internet and confirmed by CAFÉ RICO will constitute a binding and fully effective contract between the parties.
4.2 CAFÉ RICO reserves the right to reject orders, for reasons of force majeure or in case of non-payment.
4.3 The information registered by CAFÉ RICO constitutes absolute proof of the order and of the entire transaction. The information recorded by the payment system constitutes absolute proof of financial transactions.
5. Prices
5.1 The prices to be paid for the items that the Client requests are those shown on this website at the time the Client places his order, and detailed in the order confirmation, including VAT or any other applicable tax, shipping costs, shipping or any other
5.2 The charge corresponding to shipping costs will be invoiced based on the rates indicated on this website at the time the Customer places his order.
6. Delivery
6.1 All orders confirmed by CAFÉ RICO will be delivered to the delivery address that the Customer specified when placing their order and within the period of time that will be confirmed with their order.
6.2 Order deliveries can only be made in the geographical areas specified on this website.
6.3 In the event that the delivery of the order cannot be made for reasons beyond Café Rico, an attempt will be made to contact the Client again to agree on a new place and date of delivery. If the delivery cannot be made either, the order will be returned to the Café Rico warehouses and from that moment the amounts received by the Client will be paid in full within fourteen (14) calendar days. Except for shipping costs. that could accrue for said transaction.
7. Verification of the merchandise
7.1 We remind you that the Customer is responsible for verifying the quantity, condition and status of the merchandise at the time it is delivered.
7.2 In the event that you notice any damage to the product or that the merchandise is incomplete, the Customer can contact and notify CAFÉ RICO within two (2) days from the delivery of their order. Once certified by CAFÉ RICO that the defect stems from a cause attributable to it, said merchandise will be replaced at no additional cost.
8. Returns
8.1 NO RETURNS WILL BE MADE UNLESS THE PRODUCT HAS ARRIVED IN BAD CONDITION OR IF THE PRODUCT DELIVERED IS NOT THE CORRECT
9. Payments
9.1 Payments made by bank card will be charged once the Client receives the order confirmation email. Your credit card details will be encrypted for security reasons.
10. Legal guarantee of the products
10.1 The products are guaranteed in accordance with the specific terms and conditions detailed in the product documentation.
10.2 The food products offered under the CAFÉ RICO brand have satisfactorily passed all the quality controls required by the applicable legislation.
11. After-Sales Service and Attention to Complaints and Claims
11.1 CAFÉ RICO invites its Clients to know and carefully read the conditions of after-sales service and commercial guarantees

12.1 The language in which the contract between CAFÉ RICO and the Client will be concluded is Spanish.
13. Force Majeure
13.1 CAFÉ RICO guarantees the quality of the products contracted through its website. All the rights that the Laws in force grant to consumers and users are guaranteed. CAFÉ RICO will make every reasonable effort to fulfill its obligations.
13.2 However, CAFÉ RICO cannot be held responsible for delays or failures in delivery caused by circumstances beyond its reasonable control. Such circumstances include strikes, wars, natural disasters or any other situation that may prevent the production, transportation or delivery of the products.
13.3 In case of delays, CAFÉ RICO will carry out its obligations as soon as reasonably possible, and reserves the right to supply any remaining product among its Clients in a fair and reasonable manner.
14. Code of conduct

15. Client Responsibilities
15.1 The Client undertakes to make lawful use of the services and products offered by CAFÉ RICO, without contravening current legislation, or harming the rights and interests of third parties.
15.2 The Client guarantees the veracity and accuracy of the data provided during the purchase, avoiding causing damage to CAFÉ RICO as a result of their incorrectness.
15.3 The Client undertakes to pay the price of the contracted products.
15.4 Failure to comply with any of these Conditions of Sale may give rise to the rejection of the order by CAFÉ RICO without the need for prior notice to the Client and without this giving the right to any compensation.
16. Applicable law and forum
16.1 These General Conditions of Sale are governed by Spanish law and any conflict or discrepancy in the interpretation or application of the same, will be submitted to the Courts and Tribunals that, where appropriate, provide the applicable legal regulations in matters of competent jurisdiction , in which, in the case of final consumers, the place of fulfillment of the obligation or the consumer's domicile is attended.
16.2 In the event that the Client is a company, both parties will submit, expressly waiving any other jurisdiction, to the Courts and Tribunals.
